The EU Commission has published it’s Commission Implementing Regulation (EU) 2016/9 on joint submission of data and data-sharing in accordance with REACH. This Regulation lays down specific duties and obligations for parties to agreements where the sharing of information and associated costs are required under REACH. It seeks to promote good management practices, ensure the efficient functioning of agreements pertaining to data sharing and the determination of costs in a fair, transparent and non-discriminatory manner. Regulation (EU) 2016/9 enters into force on the 26th January 2016, but applies with immediate effect to existing data sharing agreements.

The Regulation is available at http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32016R0009, and ECHA plan to update their Data Sharing Guidance in due course.
