Mutual Recognition Agreements

AgreementThe Safety, Health and Welfare at Work Act 2005 (Agreement to Recognise) Order 2019 (S.I. No. 191 of 2019) confers on the Health and Safety Authority, the function to enter into agreements with persons or bodies involved in Safety, Health and Welfare at work in regard to the recognition of matters related to the functions of the Health and Safety Authority.

In line with Regulation 19(3)(a) of the Safety, Health and Welfare at Work (Diving) Regulations 2018 and 2019, the Health and Safety Authority has entered into agreements in relation to medical certificates of fitness with the Health and Safety Executive (Northern Ireland) and the Health and Safety Executive (UK). 

Agreement with the Health and Safety Executive (Northern Ireland)

This agreement means that:

  • Certificates of medical fitness to dive issued by Medical Examiners of Divers operating within Northern Ireland and approved under The Diving at Work Regulations (Northern Ireland) 2005 (No.45 of 2005) to carry out medical examinations of divers will automatically be recognised when divers are operating under the Safety, Health and Welfare at Work (Diving) Regulations 2018 and 2019 (S.I. No.254 of 2018 as amended by S.I. No.180 of 2019). 
  • Certificates of medical fitness to dive issued by Medical Examiners of Divers operating within the Republic of Ireland and approved under the Safety, Health and Welfare at Work (Diving) Regulations 2018 and 2019 to carry out medical examinations of divers will automatically be recognised when divers are operating under The Diving at Work Regulations (Northern Ireland) 2005.

Agreement with the Health and Safety Executive (United Kingdom)

This agreement means that:

  • Certificates of medical fitness to dive issued by Medical Examiners of Divers operating within Great Britain and approved under The Diving at Work Regulations 1997 (1997 No.2776) to carry out medical examinations of divers will automatically be recognised when divers are operating under the Safety, Health and Welfare at Work (Diving) Regulations 2018 and 2019 (S.I. No.254 of 2018 as amended by S.I. No.180 of 2019). 
  • Certificates of medical fitness to dive issued by Medical Examiners of Divers operating within the Republic of Ireland and approved under the Safety, Health and Welfare at Work (Diving) Regulations 2018 and 2019 to carry out medical examinations of divers will automatically be recognised when divers are operating under The Diving at Work Regulations 1997.
